Abigail Hickinbottom enjoys a mixed practice encompassing all aspects of civil and family law. In civil law she is experienced in the fields of personal injury and contract and has a particular interest in employment. In employment law she has appeared in and advised upon a number of different matters including unfair dismissals, holiday pay claims and disability and race discrimination cases. She has experience of both public and private family law including care proceedings, injunctions and contact and residence disputes.

Personal Injury

Advises, settles pleadings and appears in small claims, fast track and multi-track matters. She has particular expertise in personal injury appearing for both Claimants and Defendants. However, she also has experience in other areas including contract law, insolvency, boundary disputes and credit-hire litigation.

Employment

Accepts instructions to act for both Claimants and Respondents in all areas of Employment Law including unfair dismissals and holiday pay claims. In May she delivered a lecture for the Sheffield Law Society on the Law on Redundancy. She has a particular interest in discrimination claims.

Recently she successfully appealed the decision of the Employment Tribunal in the case of J Bowers v William Hill Organisation Ltd UKEAT/0046/09/DM, a Disability Discrimination Act case. The Appeal explored the nature and extent of a concession by a Respondent that a Claimant was disabled within the meaning of the DDA 1995, at the ‘relevant time’. Following the successful appeal she represented the Claimant at the Remedies Hearing where the Claimant was awarded over £80,000.

Family

Has represented parents, intervenors, Guardians and the Local Authority in care proceedings. Her experience also includes appearing in applications for Interim Care Orders, Emergency Protection Orders and Secure Accommodation Orders. She has also appeared in private law matters including in injunctions, and in contact and residence disputes.
