
Sukhdev Garcha is a former solicitor with over 12 years’ post qualification in crime, having been admitted in 1996. He qualified as a Higher Court Advocate in January 2006. He has experience in defending serious and complex criminal cases.
Sukhdev is a member of the VHCC panel of Advocates. Sukhdev is fluent in Punjabi, Hindi and has working understanding of Urdu.

Fraud
R-v B Pearson (Court of Appeal-Criminal Division)
Defendant convicted of ILEA education fraud. Instructed to deal with Appeal against conviction, sentence and confiscation before a full court of the Criminal Division of the Court of Appeal.
R-v-K S and others (Southwark Crown Court)
Described by Customs and Excise as ‘one (perhaps the largest) of a very large number of cases involving VAT fraud’. The case involves a Carousel fraud involving some 18 co-defendants with an estimated loss to the revenue of £250 million. Sukhdev is instructed as junior counsel to Nigel Sangster QC. The matter is a designated VHCC.
Murder and other violent offences
R-v- Risat Ali Khan (Sheffield Crown Court)
Defendant, along with 2 others, charged with conspiracy to commit murder. Case dismissed on the first day of trial following a successful application to dismiss the charges.
R-v-Marvin Tyson (Birmingham Crown Court)
The defendant, along with another, is charged with murder. The case involves a fatal stabbing outside the Q club in the city centre of Birmingham. The case involves issue of joint enterprise. Sukhdev is instructed as junior counsel to Christopher Hotton QC.
R-v-Jordan Churchill (Derby Crown Court)
Defendant charged with Aggravated Burglary, involving forcing entry into the complainant’s house and assaulting the complainant with a sawn off shot gun. The court considered the issue of dangerousness.
R-v-Ryan Daros (Birmingham Crown Court)
Defendant, together with 8 others, charged with violent disorder. All defendants, save for 2 are youths. Issue of identification by police officers from CCTV evidence
Drugs
R-v-Alan Knott (Liverpool Crown Court)
Conspiracy to import vast amounts of class A and Class B drugs into the Northwest of England. Defendant’s role described as ‘joint head of the transport organisation’. Case involved evidence of a ‘super grass’.
R-v-J Rae and others (Old Bailey)
The case related to a large scale conspiracy involving the importation and distribution of Class A drugs. The case involved volumes of covert and intrusive surveillance which showed links to the notorious Turkish mafia ‘The Baybasins’ There were 4-5 weeks of legal arguments involving abuse of process, PII, Section 44 Criminal Justice Act 2003 application for trial without a jury.
R-v- D Nyugen (Court of Appeal-Criminal Division)
Case involved cultivation of cannabis on a large scale. Represented the defendant at the Court of Appeal during which the full court gave some guidance in relation to sentencing for cultivation of cannabis [R-v- XU and others (2007) EWCA Crim 3129].
R-v-Sheraz Ali and others (Stoke-on-Trent Crown Court)
Conspiracy to supply Class A drugs to uncover police officers (Operation Nemesis).
Sexual offences
R-v-Leon Dixon (Wolverhampton Crown Court)
Defendant charged with sexual assault and indecent exposure. Case involved issue of fitness to plead.

Defendant charged with sexual activity in the presence of children, one of whom was 6 years old. Case involved issues of “dangerousness”.
