This lecture will examine the uneasy relationship between rescue and recovery objectives of assisting ailing businesses and the protection of employee rights, which lies at the heart of TUPE. By reference to recent cases, David Berkley QC will review the application of Regulations 8 and 9 TUPE 2006 to the different insolvency situations.
